¡ABSOLUCIÓN DE LOS PETROLEROS DE LAS HERAS!

La FORA convoca una jornada internacional de protesta por los petroleros de las Heras el 24 de marzo.

Desde la Federación Obrera Regional Argentina estamos comprometidos con la causa de los trabajadores de Las Heras, y venimos realizando diferentes acciones en solidaridad.. Queremos convocar a todas las Secciones de la AIT a movilizarse y realizar acciones de protesta en las delegaciones argentinas del mundo el día 24 de Marzo, día que en nuestro país al conmemorarse otro año de la ultima dictadura militar se tomara como eje principal la libertad de los petroleros de Las Heras.

LA CAUSA

2006: Los trabajadores petroleros, algunos tercerizados, salen a protestar contra el impuesto a las ganancias, por el pase a planta y por entrar al convenio colectivo de trabajo del Sindicato de Petroleros (lo cual significaba un aumento en sus ingresos). Luego de 20 días de paro, en un acto de provocación del Gobernador de la provincia de Santa Cruz, el vocero de los trabajadores es detenido mientras le hablaba por radio a la población. Durante la poblada que sale en su defensa, muere el oficial de policía Jorge Sayago.

2007-2008: Se establece una cacería en busca del culpable. Se detiene y tortura, se establece el toque de queda y la militarización del pueblo a manos la Gendarmería. Con las declaraciones de los detenidos, quienes son retenidos en sus domicilios, golpeados y presionados, se arma “la Causa”: El tío de Sayago, Víctor Álvarez, declara que quienes están sentados en el banquillo no son más que chivos expiatorios. Una de las abogadas defensoras, Claudia Ferrero, afirmó que “no hay ninguna prueba concreta, (las que hay) fueron armadas por la Brigada de Investigaciones de Santa Cruz en base a apremios y torturas, aterrorizando a toda la población en esa época y consiguiendo testimonios falsos a través de amenazas y persecuciones”.

2009: Continúa la militarización y persecución en el pueblo de Las Heras. Los trabajadores permanecen detenidos por 3 años, en condiciones de torturas físicas y psicológicas todos ellos.

2013: Se formaliza el pedido de cadena perpetua para seis de los procesados y 18 años para el resto. El Fiscal Candia, en una audiencia, reconoce la tortura y los apremios ilegales. Al mismo tiempo declara que “DARLE UN CACHETAZO O PONERLE UNA BOLSA EN LA CABEZA A UN TESTIGO NO IMPLICA DECIRLE LO QUÉ TIENE QUE DECIR”. El tribunal hace oídos sordos a las denuncias de torturas y deja detenido a los procesados para que “reflexionen y recapaciten”.

Diciembre de 2013: se dicta la condena a cuatro trabajadores petroleros, CORTEZ, ROSALES, PADILLA Y GONZALES a perpetua y a otros seis trabajadores a cinco años de prisión. Este es uno de los mayores ataques a trabajadores que luchan por sus derechos, casi sin precedentes en gobiernos constitucionales, con el firme objetivo de disciplinar la lucha del movimiento obrero.

2013-2014: Amplios sectores del movimiento obrero se movilizan exigiendo la absolución de los trabajadores petroleros de Las Heras condenados. Con el transcurrir de los meses se realizan cada vez más acciones en solidaridad. A su vez, el gobierno nacional ordena la represión y el desalojo de todos los piquetes y manifestaciones realizados por esta causa, con muchos heridos y detenidos.

Los trabajadores y trabajadoras que componemos la Federación Obrera Regional Argentina estamos comprometidos con la causa de los trabajadores de Las Heras, es por eso que venimos realizando diferentes acciones directas en solidaridad. Por esto solicitamos que la AIT haga propia esta lucha, no solo para sumar fuerzas en pos de la absolución de los petroleros, sino porque una condena de esta magnitud en Argentina sienta un precedente nefasto para la organización obrera.

COMUNICADO DE LA FORA-AIT

El 12 de diciembre de 2013, el Poder Judicial de Santa Cruz condenó a cuatro trabajadores petroleros – Ramón Cortéz, José Rosales, Franco Padilla y Hugo González – a cadena perpetua y a otros seis, a cinco años de prisión, por supuesta coacción agravada, lesiones y el asesinato de

un oficial de policía.

Lo único que se demostró en el juicio son las torturas que sufrieron los condenados, con el propósito de sacarles una declaración que los encontrara culpables, actos que fueron justificados por el fiscal de la causa que minimizó las torturas.

En el 2006, los petroleros de Las Heras reclamaban por su encuadramiento sindical en la rama petrolera en la que efectivamente trabajan, y no en la UOCRA, y así incorporarse a otro convenio colectivo con mejores escalas salariales y condiciones de trabajo, reclamaban la suba del mínimo no imponible, monto a partir del cual los asalariados tributan impuesto a las ganancias.

Cuando la huelga y las movilizaciones llevaban 20 días, el Poder Judicial ordenó la detención de varios trabajadores. Los petroleros reaccionaron marchando sobre la alcaldía a exigir su liberación y fueron brutalmente reprimidos. En circunstancias por demás confusas, cayó muerto el policía Jorge Sayago. Fueron apresados 17 trabajadores (y varios vecinos) y acusados por desmanes y asesinato, instalando la gendarmería un clima de terror en la población.

Esto de criminalizar el reclamo de los trabajadores no es nuevo.

También procesaron a los detenidos durante la represión en el Hospital Borda – mientras los funcionarios de Macri fueron absueltos – y persiguen a los obreros que luchan como los delegados de las empresas Emfer, Lear y Kraft, en la zona norte del Gran Buenos Aires, que se encuentra militarizada con la gendarmería. Un trabajador de la línea 60 de colectivo fue condenado a 7 meses de prisión efectiva por el sólo hecho de reclamar su reincorporación. También exigimos su absolución.

La Federación Obrera Reginal Argentina (FORA-AIT) expresa su más enérgico repudio a la condena recibida, hacia quienes por darle pelea a la injusticia, están queriendo ser sepultados en vida por el poder de las petroleras y el Estado Argentino. Es por ello que desde esta federación de trabajadores extendemos nuestro más profundo sentimiento de solidaridad a los petroleros de Las Heras y alentamos a que más trabajadores se sumen a la campaña por la absolución.

Para que la solidaridad no solo sea palabra escrita y las ideas no se pierdan tras las rejas, los trabajadores debemos salir a la calle con todas nuestras fuerzas y devolver a los compañeros condenados a sus hogares.

Amnesty for the Oil Workers of las Heras

FORA is calling for an international day of protest for the oil workers of Las Heras on March 24.

The Regional Workers´ Federation of Argentina is committed to the cause of the workers of Las Heras and we have been making different solidarity actions. We would like all the Sections of the IWA to mobilize and make protests at government offices of Argentina (Embassies, Consulates...) on March 24, (a day which in our country commemorates another year of the last military dictatorship), with the aim of freeing the oil workers of Las Heras.

THE CAUSES

2006: The oil workers, some of them outsourced, protest against a tax on their earnings, for entrance to the plant and to enter into the collective agreement of the Oil Workers Unions (which would mean a raise in salary). After 20 days of strike, in an act of provocation by the Governor of the province of Santa Cruz, the spokesperson of the workers was detained while speaking on the radio. During the actions in his defense, a police office, Jorge Sayago died.

2007-2008: A hunt follows, looked for the guilty party. People are arrested and tortured. Curfews and the militarization of the town by the Gendarmes. With the statements of those detained in their homes, beaten and pressured, “The Cause” arms itself: the uncle of Sayago, declares that those sitting on the bench, facing charges, are just scapegoats. One of the defense lawyers, Claudia Ferrero, admitted that “there is no concrete evidence), and those that were, were based by the Investigative Brigade of Santa Cruz on torture, terrorizing the whole population and getting false testimony through threats and persecutions.

2009: Militarization and persecution continues in the town of Las Heras. The workers have already been detained for 3 years, in conditions of physical and psychological torture.

2013: The request for life imprisonment of 6 of the accused and 18 years for the rest. The Prosecutor Candia, admits the torture and the illegal mistreatment. At the same time he declares “PUTTING A BAG OVER THE WITNESSES HEAD AND SLAPPING HIM IS NOT THE SAME AS TELLING HIM WHAT TO SAY”. The court turns a deaf ear to the information about torture and leaves the defendants to “reflect and reconsider”.

December 2013: four oil workers are convicted for life, CORTEZ, ROSALES, PADILLA Y GONZALES and another 6 workers to 5 years in prison. This is one of the greatest attacks against workers who were fighting for their rights, almost without precedence in constitutional governments, with the goal of punishing the workers' struggle.

2013-2014: Various sectors of the workers' movement mobilize demanding the amnesty of the condemned oil workers of Las Heras. With every month, more and more solidarity actions take place. In turn, the national government orders the repression and breaking of all the pickets and demonstrations and there are many injured and arrested.

The workers of the Regional Workers' Federation of Argentina are committed to the cause of the workers of Las Heras, and because of this have been making different solidarity actions. We ask the IWA to make actions as well, not only to join forces for the amnesty of the oil workers, but because a conviction of this magnitude in Argentina is a dangerous precedent for workers' organization.

STATEMENT OF FORA-AIT

On Decemeber 12, 2013, the Santa Cruz Judiciary sentences four oil workers - Ramón Cortéz, José Rosales, Franco Padilla y Hugo González – to life imprisonment and another 6 to 5 years in prison for the alleged aggravated coercion, injury and murder of a police officer.

The only thing that was proven in the court was the torture which those sentenced suffered, in order to extort incriminating statements, acts which were justified by the Prosecutor which downplayed the torture.

In 2006, the oil workers of Las Heras demanded to be included in the union agreement in the oil sector which they worked in, not in the UOCRA, and thus to be included in a collective agreement with better pay scales and working conditions, demanding a raise in their non-taxable income.

After 20 days of the workers' mobilization, the Judiciary ordered the detention of various workers. The oil workers reacted by demonstrating on City Hall to demand their release and they were brutally repressed. In confusing circumstances, a police office, Jorge Sayago, died. 17 workers (and different neighbours) were arrested and accused of misdeeds and murder, with the Gendarmes installing a climate of terror in the population.

Criminalizing of the demands of the workers is nothing new.

They also prosecuted workers during a repression in the Borda Hospital – while the Macri functionaries were acquitted – and the continue to persecute the workers in struggle like the delegates from the Emfer, Lear and Kraft companies, in the northern zone of Greater Buenos Aires, which is militarized with the gendarmes. A worker of the line 60 was sentenced to 7 months in prison only for demanding his reinstatement. We also demand his release.

The Argentine Regional Workers' Federation (FORA-AIT) expresses is strongest condemnation for the sentences received by those who fight injustice, which the oil companies and the Argentine state want to bury alive. Our workers' federation extends its most profound solidarity with the oil workers of Las Heras and encourage more workers to join the campaign for their freedom.

So that solidarity is not only a written word and ideas are not lost behind bars, workers should go on the streets with all our strength in order that the condemned comrades be returned to their homes.
